This research engages with the problem of company-community conflict in mining. The inequitable distributions of risks, impacts, and benefits are key drivers of resource conflicts and are likely to remain at the forefront of mining-related research and advocacy. Procedural and interactional forms of justice therefore lie at the very heart of some of the real and ongoing challenges in mining, including: intractable local-level conflict; emerging global norms and performance standards; and ever-increasing expectations for the industry to translate high-level corporate social (...) responsibility policy into on-the-ground practice. This research focuses on the "process" aspects of resource conflicts through an examination of existing grievance-handling procedures at six mining operations where company-community conflict was present. The total and the sharp character of orthodox quantum logic has been put in question in different contexts. This paper presents the basic ideas for a unified approach to partial and unsharp forms of quantum logic. We prove a completeness theorem for some partial logics based on orthoalgebras and orthomodular posets. We introduce the notion of unsharp orthoalgebra and of generalized MV algebra. The class of all effects of any Hilbert space gives rise to particular examples of these structures. Constructibility and complexity play central roles in recent research in computer science, mathematics and physics. For example, scientists are investigating the complexity of computer programs, constructive proofs in mathematics and the randomness of physical processes. But there are different approaches to the explication of these concepts. This volume presents important research on the state of this discussion, especially as it refers to quantum mechanics. This `foundational debate' in computer science, mathematics and physics was already fully developed in 1930 in the (...) Vienna Circle. A special section is devoted to its real founder Hans Hahn, referring to his contribution to the history and philosophy of science. Contemporary moral philosophy is split between an inherently a-historical moral philosophy/theory on the one hand and a growing interest in moral history and the historicity of morality on the other. In between these, the very moments of moral change are often left insufficiently attended to and under-theorized. Yet moral change is, arguably, one of the defining features of present day moral frameworks, and thus one of the main things we need to make sense of in moral philosophy. In this paper, (...) I present an account of moral change through the use of three metaphors: the tipping point, the bargaining table and the strong rope. I suggest these as coordinates for the development of a full-blown, historically sensitive conception of morality. (shrink)

The debate about constructivism in physics has led to different kinds of questions that can be conventionally framed in two classes. One concerns the mathematics that is considered for the theoretical development of physics. The other is concerned with the experimental parts of physical theories. It is unnecessary to observe that the intersection between our two classes of problems is far from being empty. In this paper we will mainly deal with topics belonging to the second class. However, let us (...) briefly mention some important problems that have been debated in the framework of our first class. For instance, the following: to what extent do the undecidability and incompleteness results of classical mathematics affect fragments of physical theories, in such way as to have a “real physical meaning”? are the mathematical arguments that seem to be essential for physics justifiable in the framework of traditional mathematical constructivism?The first question has recently been investigated by Pitowski, Penrose, da Costa, Doria, Mundici, Svozil and others. As expected by most logicians, one can construct undecidable sentences whose physical meaning seems to be hardly questionable. This happens both in classical and in quantum mechanics. (shrink)

I Norge har vi hatt kontroverser omkring regulering avhumanmedisinsk bioteknologi siden 1980-tallet. Denneartikkelen analyserer et lite utsnitt av disse reguleringsdebattene,nærmere bestemt kontroversen omkring forskningpå befruktede egg. Med utgangspunkt i skriftlig materialeknyttet til tre reguleringsrunder undersøker vi her hvordan ulike aktører arbeidet forå ramme inn denne kontroversen, bl.a. ved hjelp av ulikevitenskapelige og politiske representasjoner av det befruktedeegget.Vi finner at det i perioden 1987–2007 ble arbeidet medulike innramminger som utgangspunkt for retoriske ogpolitiske strategier: På den ene siden ser vi forsøk på (...) å innrammekontroversen i et risikorammeverk som først ogfremst fokuserte på de potensielle negative sidene vedhumanmedisinsk bioteknologi, og som spesielt vektlarespekten for det ufødte liv. På den andre siden ser vi atman arbeidet med en forventningsinnramming som lahovedvekten på håpet om nye behandlingsregimer foralvorlig syke mennesker.Forbudet mot forskning på befruktede egg som ble vedtatti 1987, ble opprettholdt i 1994 og 2003. Med lovendringeni 2008 fikk vi imidlertid et markant brudd i dennorske lovgivningspraksisen, da forskning på befruktedeegg ble tillatt på visse premisser. Vi argumenterer for at den viktigste årsaken til denne lovendringen var Mehmet-saken, en sak som medførtesåkalte «oversvømmelser» i begge innrammingsforsøkenesom er omtalt ovenfor. Mehmet-saken eksponerte samtidig et generelt demokratiskdilemma. Concerns and expectationsregarding research on fertilized eggsSince the 1980s, there have been several debates and controversies concerningthe regulation of medical biotechnology. In this article, we analyze three suchinstances in Norway, mainly the debates concerning research on fertilizedeggs. Analyzing the debates surrounding the regulations of 1994, 2003/2004and 2008, we investigate how different stakeholders strived to mobilize whatwe call different framings of the controversy, utilizing the different scientificand political representations of the fertilized egg.Framing involves creating baselines for rhetorical and political stratagems.Two framings appear more pronounced than others in the Norwegian debate.On one hand, we find attempts of framing the controversy in a risk centricframework, which mostly emphasizes the potential negative effects of medicalbiotechnology as it focuses on the universal reverence for the unborn life. Onthe other hand, we see attempts to mobilize a positive frame of expectationthat emphasizes on the hope of finding new and effective treatment options forthe severely ill.The ban against research on fertilized eggs that was passed in Norway in1987 was repeated in 1994 and 2003. However, with the changes introducedto the law in 2008, there was a noticeable shift in Norwegian legislation, asresearch on fertilized eggs became permissible if specific conditions were met.We argue that the turning point in this regulative change was the Mehmentcase, a particular case that entailed the so-called «overflowing» in both the negative and the positive frame. The Mehmet case exposed a moregeneral democratic and political dilemma. In our opinion, it illustrates howvulnerable can regulation that is based on general ethical principles be in theface of what appears to the laity as unreasonable. Thus, we argue that thisactualizes the need for more hybridized ways to view the relationship betweenthe universal and the particular, between principle-based ethics and theunderstandings of lay people, between facts, and values and actual cases inpolicy shaping and practice. Il lavoro analizza la tempestiva ricezione da parte di Cornelio Fabro della filosofia di Carl Stumpf, così come esposta nella postuma Erkenntnislehre. Fin dai lavori dei primi anni Quaranta Fabro adotta una concezione della ‘fenomenologia’ distante da quella di Husserl perché ricalcata sulla definizione stumpfiana. Più in generale, Fabro si ispira a Stumpf ancor più che allo stesso Brentano. A partire dalla distinzione tra ‘fenomeni' e ‘funzioni psichiche’ Stumpf è infatti capace di proseguire il rilancio dell’aristotelismo con coerenza ancor (...) maggiore del maestro, all’insegna di un pieno riconoscimento del significato conoscitivo della percezione contro gli tipici di eccessi di ogni forma di intellettualismo. Objectives: To report the attitudes and opinions of subjects in US clinical trials about whether or not, and why, they should receive post-trial access (PTA) to the trial drug, care and information. Design: Focus groups, short self-administered questionnaires. Setting: Boston, Dallas, Detroit, Oklahoma City. Participants: Current and recent subjects in clinical trials, primarily for chronic diseases. Results: 93 individuals participated in 10 focus groups. Many thought researchers, sponsors, health insurers and others share obligations to facilitate PTA to the trial drug, (...) if it benefited the subject, or to a therapeutic equivalent. Some thought PTA obligations include providing transition care (referrals to non-trial physicians or other trials, limited follow-up, short-term drug supply) or care for long-term adverse events. Others held, in contrast, that there are no PTA obligations regarding drugs or care. However, there was agreement that former subjects should receive information (drug name, dosage received, market approval date, long-term adverse effects, trial results). Participants frequently appealed to health need, cost, relationships, reciprocity, free choice and sponsor self-interest to support their views. Many of their reasons overlapped with those commonly discussed by bioethicists. Conclusion: Many participants in US trials for chronic conditions thought there are obligations to facilitate PTA to the trial drug at a “fair” price; these views were less demanding than those of non-US subjects in other studies. However, our participants’ views about informational obligations were broader than those of other subjects and many bioethicists. Our results suggest that the PTA debate should expand beyond the trial drug and aggregate results. (shrink)

The paper points out the reasons for the substitution of the concept of reason’s striving for the concept of will in J.G. Fichte’s later writings, and particularly in his lectures on the Facts of Consciousness of 1813. In this way, it is possible to rethink R. Lauth’s interpretation, according to which Fichtian philosophizing would reconsider the primacy attributed by modernity to theoretical knowledge and would succeed in constructing a “nova method” philosophy, but would fail to overcome a ‘horizontal’ conception of (...) reason with a view to the formation of a “prima methodo” philosophy. The latter would start, not from the striving-affection correlation, but from the self-clarification of reason according to the task it sets for itself. After an overview of the doctrine of striving in the context of a philosophical exposition nova methodo, (§2) we define how Fichte rethinks it in terms of a will capable of coherently ordering constellations of events and how such ordering underlies an understanding of the world as the horizon of coherent human action (§3). A recent study by P.R. Blum suggests the hypothesis of an ideal line from Scotus to Mastri, passing through Perera, which would tend towards a new concept of metaphysics attainable through the use of abstraction by indifference. This essay intends to test this hypothesis starting from the way in which Perera questions the unity of metaphysical abstraction through a series of innovative interpretations that are widely received in both Catholic and Reformed and Protestant domains. A first interpretation, less radical, advances (...) a model of metaphysical abstraction, taken up by Mastri and Micraelius, which maintains the unity of metaphysics; a second interpretation, more radical, breaks the methodological unity of metaphysics through a clear distinction between ‘real’ abstraction from matter (secundum rem et rationem) and ‘mental’ abstraction by indifference (secundum rationem tantum) and, consequently, between metaphysics and ontology. Dante, primo comparatista, è in grado di reinventare, armonizzandoli, elementi strutturali e tematici provenienti sia dalle visiones latine che dalla tradizione islamica del Isra’ wa’ l Mi‘râj.The purpose of this essay is to make a confrontation between the main important visiones of the Occidental Literature – also the Visio Pauli and the Dante’s Commedia – anche the various redactions of the Islamic Isra’ wa-l mi’râj. The confrontation is in order to establish if the remarked affinities are just due to polygenesis or rather caused by concrete intertestuality.Between the visiones, the mirajic tradition and the Commedia we are in front of a three voices dialogue: it’s like a symphony, in which the themes enriches themselves and, at least, the arrive to Dante for being harmonized. Hare defends utilitarianism at some length against the objection that it has consequences that are inconsistent with our common-sense or intuitive moral judgments. In questo articolo rifletto sulla nascita della grammatica araba e il suo sviluppo come fonte dell’esegesi coranica dall’VIII al XIV secolo. Il legame tra esegesi e grammatica è stato oggetto di diversi studi che esaminano le origini delle categorie grammaticali. Sebbene non ci sia evidenza di uno spiccato interesse per la grammatica da parte degli esegeti coranici, essi hanno comunque dovuto adoperarla per spiegare i significati del testo sacro. In particolare, nei commentari classici è data particolare attenzione alla lessicografia e (...) meno alla struttura grammaticale. A ogni modo, in alcuni passaggi, anche se sporadici, le categorie grammaticali stesse fungono da spiegazione, essendo portatrici di significati. Questo si evince dalla letteratura sufi dove le terminologie della grammatica araba sono simboli delle stazioni dell’anima nel cammino spirituale, come nella _Grammatica dei cuori_ di al-Qushayrī. In questo articolo, analizzo il ruolo della grammatica nelle Scienze Coraniche secondo il teologo al-Ghazālī e dopo una panoramica della storia della disciplina nel periodo classico della storia islamica, e evidenzio il modo in cui le terminologie grammaticali servono per la comprensione profonda del significato nella Sūra al-Fātiha nel commentario sunnita di Ibn Kathīr. In this article I reflect on the emergence of Arabic grammar and its development as a source for Qur’ān exegesis from VIII to XIV century. The connection between exegesis and grammar has been the subject of several studies examining the origin of grammatical categories. Although there is no evidence of a clear interest for grammar by Qur’ān exegetes, they necessarily used it to explain the meanings of the sacred text. In particular, in the classical commentaries there is a particular attention to lexicography and less to the grammatical structure. However, in some passages, even if sporadic, the grammatical categories themselves perform an explanatory function, being bearers of meanings. This is manifest in Sufi literature where Arabic grammar terminologies are symbols of the stations of souls in the spiritual path, like in the _Grammar of the heart_ by al-Qushayrī. In this article, I analyse the status of grammar in Quranic Sciences according to the theologian al-Ghazālī and after an overview on the history of the discipline in the classical period of Islamic History, and I highlight the way grammar terminologies serve as a key to understand profound meaning in sura al-Fātiha in Ibn Kathīr’s sunni commentary.
